MEP calls for tougher action against product piracy

Gianluca Susta an Italian MEP is calling for a much tougher line to be taken against product piracy. In the draft – PDF file – of a report by the European Parliament on the impact of product counterfeiting he calls for the creation of an EU agency to coordinate countermeasures against product piracy. He claims such an agency would improve the effectiveness of the measures already in place, and would create “synergies” with private enterprise. The MEP is also calling for an extension of the trade-related aspects of the World Trade Organization’s intellectual property rights agreement TRIPS and for a speedy conclusion to the ‘Anti-Counterfeiting Trade Agreement’ (ACTA) being drawn up by the leading industrial nations.

(AGI) – Bruxelles, 14 lug. – Un’authority europea per la lotta alla contraffazione e alla pirateria; maggior attivismo a Bruxelles nel presentare ricorsi al WTO; stringere accordi bilaterali, regionali e multilaterali con i Paesi emergenti per la rapida soluzione delle controversie e relative sanzioni; concludere al piu’ presto i negoziati per l’ACTA (Anti Counterfeiting Trade Agreement) che coinvolgono Unione Europea, Stati Uniti, Australia, Canada, Svizzera, Singapore, Emirati Arabi Uniti, ecc.

Sono queste le principali proposte presentate oggi a Bruxelles dall’eurodeputato italiano Gianluca Susta, in materia di lotta alla contraffazione. Discussa per la prima volta oggi in Commissione Commercio internazionale, la relazione “deplora inoltre la mancata adozione da parte del Consiglio della normativa ‘Made in’ che permetterebbe una migliore tracciabilita’ e riconoscibilita’ dell’origine dei prodotti importati e auspica che gli ostacoli che si sono fino ad ora frapposti possano essere definitivamente superati”.

La relazione ricorda, infine, che nel 2007 l’ammontare dei beni in violazione dei diritti di proprieta’ intellettuale (DPI) sequestrati dalle autorita’doganali dell’Unione europea e’ aumentato del 17% rispetto all’anno precedente, con un incremento del 264% per cosmetici e prodotti di igiene personale, del 98% per i giocattoli e del 51% per i medicinali.”Con un fatturato totale di 500 miliardi di euro, la contraffazione colpisce maggiormente l’Unione europea e deve diventare – conclude Susta – una priorita’ per la Commissione come e gli Stati membri”. Despite earlier statements by European negotiators that the planned Anti-Counterfeiting Trade Agreement (ACTA) would need time for fine-tuning, nations seem to accept a fast track movement now. ACTA has been mentioned as an agenda item of the French presidency of the European Union (from July to January), the European Commission’s Trade Directorate General (DG Trade) prepared a public report about its consultation with stakeholders in June, and the European Parliament has included ACTA in a draft report on the “impact of counterfeiting on international trade.” On Tuesday, Luc Chatel, secretary of state for consumer affairs and industry, and spokesman for the French government, explained that [pdf] the fight against piracy and counterfeiting is high on the agenda of the French presidency. Chatel said, “During her presidency, France will work hard to make progress in this fight by taking a global approach.”

France would aim to present, during the EU Council meeting on competition policies 25-26 September, an integrated concept including a new plan for border controls that would update the border regulation currently in effect. In addition to creating an observatory against counterfeiting and better cooperation and information exchange among EU governments – using also the European Anti-Fraud Office, ACTA is indispensable to realising global cooperation and the enforcement of IP rights, Chatel said.
